Abstract

A la chute d'une dictature, quand les armes se taisent a la fin d'un conflit, comment reconstruire des communautes politiques sur les bases des traumatismes vecus ? De quelle maniere favoriser la reconciliation des peuples et, peut-etre, leur democratisation ? La justice transitionnelle constitue, tant dans la pensee que dans la pratique des acteurs internationaux, une des reponses possibles a ces questions. En mettant en place des mecanismes censes permettre de faire face au passe (proces, commissions verite, reparations, reformes des institutions ...), la justice transitionnelle apporte la promesse de la reconnaissance, du retour de la confiance, de la regle du droit et, a terme, de la reconciliation. Les contributions de cet ouvrage analysent, a travers des etudes de cas diverses (Argentine, Tunisie, Rwanda, Cambodge, Republique democratique du Congo ...) ou en offrant des constructions theoriques interdisciplinaires, les formes et les enjeux que posent ainsi a la justice, sous toutes ses formes, les peuples en transition. A la croisee de la philosophie, de la sociologie, du droit, de l'histoire et des sciences politiques, les textes ici reunis donnent a penser la complexite et les enjeux des processus de democratisation pour les peuples qui sortent de l'experience de la violence politique.

"All over the world the practice of peacebuilding is beset with common dilemmas: peace versus justice, religious versus secular approaches, individual versus structural justice, reconciliation versus retribution, and the harmonization of the sheer multiplicity of practices involved in repairing past harms. Progress towards the resolution of these dilemmas requires far more than reforming institutions and practices but rather clear thinking about the more basic questions: What is justice? And how is it related to the building of peace? The twin concepts of reconciliation and restorative justice, both involving the holistic restoration of right relationship, contain not only a compelling logic of justice but also great promise for resolving peacebuilding's tensions and for constructing and assessing its institutions and practices. This volume furthers this potential by developing not only the core content of these concepts but also their implications for accountability, forgiveness, reparations, traditional practices, human rights, and international law. While the volume's central orientation is theory, it contains much of interest to a wide range of scholars as well as practitioners. It is both interdisciplinary and accessibly written.
